How we work
Technical development has led to new forms of mass utilization. In these areas it is no longer possible for the right holders to safeguard their individual rights. This concerns for example cable television, rental rights and the blank tape remuneration. DAMA collectively protects the right holders' claims arising from utilization of this nature.
With a repertoire totally independent from others collective societies' repertoires, DAMA administers authors' rights of an audiovisual work:
- Director
- Writers of the script and the adaptation, and those of the dialogue.
- Musical composers, with or without words, which are created specially for the work.
Monitoring, collecting and distributing the payment of royalties for its member's right holder, every three months, on the basis of the Spanish law, with respect to Spain.
With the adequate administrative processes and databases, rights are collected under two major premises:
- On the demand of sending the repertoire entrusted: DAMA communicates to right users its member's repertoire, collecting for it in the authorship percentage declared by them.
- Payment according the real use of the repertoire: DAMA only claims to broadcasters or others rights users by the audiovisual works effective broadcasted, rented or exhibited.
COMMISSION
DAMA is a non profit organisation. The running of the company is funded by the subscription charged for membership and by the commission deducted from royalties distributed to members.
The current commission charges on royalties distributed to the Ordinary Members is 12% maximum.
The commission level is set each year by the Board and our operational costs are looked at in great detail to ensure that the maximum benefit is passed on to our members at all times.
